π Extended Time Limit to File Updated Income Tax Returns (ITR-U) β Now 4 Years!
The Union Budget 2025 has brought great relief to taxpayers. One major change is:
π You now get 4 years instead of 2 years to file an Updated Return (ITR-U) if you missed or wrongly filed your earlier return.
π§Ύ What is an Updated Return (ITR-U)?
An ITR-U lets you correct your old return or file one even if you missed filing earlier — but with extra tax & penalty.
-
You can file it even if you missed original or belated return.
-
You can also use it to declare extra income to avoid penalties later.
π What Was the Rule Before?
Earlier, as per Section 139(8A) of the Income Tax Act:
-
You had only 2 years from the end of the relevant financial year to file an updated return (ITR-U).
π΄ Example (Before):
Mr. Ramesh forgot to file his ITR for FY 2021-22 (AY 2022-23).
-
The last date to file an updated return was March 31, 2025.
If he missed that, he couldn’t fix it legally.
β What Has Changed Now?
From Budget 2025, the time to file ITR-U is extended to 4 years!
β Example (After):
Now Mr. Ramesh gets time till March 31, 2027 to file his ITR for FY 2021-22.
Even if he missed everything earlier, he can still:
-
File an updated return
-
Declare income
-
Avoid future legal trouble
π‘ Practical Case Study
Case 1: Missed Filing Completely
-
Mrs. Shah didn’t file her ITR for FY 2020-21.
-
Earlier: Deadline expired on March 31, 2023 (2 years).
-
Now: She gets time until March 31, 2025 (4 years total).
Case 2: Filed but Forgot to Report One Property
-
Mr. Anil filed his return for FY 2022-23 but forgot to show rent income.
-
He realizes this in 2026.
-
He can now file ITR-U before March 31, 2027 to add the rent income.
π§Ύ Penalty Still Applies
Even with this extra time, the updated return:
-
Cannot be filed to reduce income or claim extra refund
-
Comes with 25% or 50% extra tax as penalty
